NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW OR REGULATION. CONTEST IS VOID OUTSIDE THE US AND WHERE PROHIBITED. MANY WILL ENTER; FEW WILL WIN.

  1. SPONSOR: BHiveLab, an entity of M.J. Brunner, Inc., 11 Stanwix St., 5th Floor, Pittsburgh, PA 15222 (BHiveLab and M.J. Brunner together shall hereinafter be referred to as the “Sponsor”).
  2. THE CONTEST & ELIGIBILITY: The BHiveLab Hacker Challenge 2013 (the “Contest”) aims to foster creative and technology innovation amongst youth and is open to legal residents of the United States who are between fourteen (14) and nineteen (19) years of age at the time of entry. An entry shall be deemed valid after entrant’s parent or legal guardian has acknowledged and accepted these Official Rules and provided verification that entrant will be allowed and able to comply and has complied with all the requirements set forth herein.
  3. COMPLIANCE WITH OFFICIAL RULES: By participating in the Contest, each entrant, and their parent or legal guardian, unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor and the Judging Panel (as defined below).
  4. THE CONTEST PERIOD: The Contest begins on Saturday, September 7, 2013 at 12:01 a.m. Eastern Time (“ET”) and ends on Saturday, October 12, 2013 at 11:59 p.m. ET (the “Contest Period”).
  5. HOW TO ENTER:
    1. Only one entry per person and only individuals may enter. No groups or teams.
    2. Original entries only.
    3. To submit an entry during the Contest Period:
      1. Get permission from your parent or legal guardian to participate in the Contest.
      2. Visit hackerchallenge.bhivelab.com and click on the “Submit Your Idea” button. Complete the two part entry form in full with all required information which includes your full name, age, street address, city, state, zip code, email address, and parent or legal guardian’s email address along with your acceptance of and agreement to comply with the Official Rules. The information you provide will only be used in accordance with Sponsor’s privacy policy.
      3. Sponsor will send an email to entrant’s parent or legal guardian at the email address provided on the entry form. In order to have a valid entry, prior to the end of the Contest Period parent or legal guardian must respond to Sponsor’s email with approval for entrant to participate in the Contest. By responding to Sponsor’s email, parents or legal guardians agree to be bound by these Official Rules. If by the end of Contest Period parent or legal guardian does not respond to Sponsor’s email as described in this section, entry will be null and void.
  6. SELECTION PROCESS & CONCEPT PRESENTATIONS:
    1. All entries will be judged according to the following criteria: Innovation, Creativity, Feasibility and Uniqueness (together, the “Criteria”). The Judging Panel (hereafter defined) will rate each entrant on a scale of 1 to 10 for each element of Criteria. Each Criteria element will be weighted equally. The entrant’s scores will be averaged, and the entrants with the highest scores will be selected. In the event of a tie during any phase of the Contest, the Judging Panel (hereafter defined), in its sole discretion, shall make a determination as to the entry that shall advance in the selection process or be awarded a prize, as the case may be.
    2. Following the end of the Contest Period, a judging panel consisting of employees of Sponsor and other businesses (together, the “Judging Panel”) will select approximately twenty entrants as finalists. Finalists, in order to continue to participate in the Contest and be eligible to compete for a prize, are required to attend an Arduino and .Net Gadget technology training session with members from the BHiveLab team of approximately 2-3 hours in duration at the Pittsburgh TechShop located at 192 Bakery Square Boulevard, Pittsburgh, PA 15206, on Saturday, November 2, 2013 (“Training Session”). The exact time for the Training Session shall be provided approximately one week prior to the Training Session.
    3. Each finalist will leave the Training Session with an Arduino Starter Kit which includes a selection of the most common and useful electronic components for building creative projects. Arduino is a tool for making computers that can sense and control more of the physical world than your desktop computer. It's an open-source physical computing platform based on a simple microcontroller board, and a development environment for writing software for the board. Arduino can be used to develop interactive objects, taking inputs from a variety of switches or sensors, and controlling a variety of lights, motors, and other physical outputs.
    4. The finalists, and their parent/legal guardian, will be notified about entrant’s selection as a finalist via email on or about October 25th, 2013. Entrant and parent/legal guardian shall both be required to confirm entrant’s continued participation in the Contest and attendance at the Training Session via reply email to Sponsor (“Finalist Confirmation Email”) no later than 11:59 P.M., November 1st, 2013. If a finalist and his/her parent/legal guardian do not provide a Finalist Confirmation Email, such finalist shall be disqualified from further participation in the Contest and the Judging Panel, in its sole discretion, may decide to choose an alternative finalist.
    5. Any finalist who does not attend the Training Session shall be disqualified from the Contest.
    6. Finalists must finalize their concept and make a 30 minute presentation to the Judging Panel on either Saturday, December 7, 2013 or Sunday, December 8, 2013 (exact date to be determined by Sponsor in its sole discretion) at Sponsor’s offices located at 11 Stanwix St., 5th Floor, Pittsburgh, PA 15222.
    7. All decisions of Sponsor and Judging Panel are final and entrants and their parents or legal guardians may not contest the results as determined by the Judging Panel at any stage of the contest.
  7. TRANSPORTATION REQUIREMENTS FOR FINALISTS: Selected finalists will need to make their own arrangements and pay for their own transportation to two events:
    1. Training Session on Saturday, November 2, 2013 at the TechShop located at 192 Bakery Square Boulevard, Pittsburgh, PA 15206, and
    2. Concept Presentation on either December 7th or 8th, 2013 at Sponsor’s offices located at 11 Stanwix St., 5th Floor, Pittsburgh, PA 15222.
  8. ORIGINAL WORK: The entry must be original work created solely by the entrant. By entering the Contest, entrant and his/her parent/legal guardian represents, acknowledges and warrants that the submitted entry in any and all stages of the Contest is an original work created solely by the entrant without any collaboration with others and that no other party has any right, title, claim or interest in the entry.
  9. OWNERSHIP: All entries submitted are the property of the Sponsor. However, Sponsor will not and does not claim ownership to the intellectual property developed by the entrant in connection with his/her entry in the Contest
  10. PRIZES:
    1. 20 Training Sessions at the TechShop, each including an Arduino Starter Kit – ARV $230.00 each.
    2. 1 First Place Prize - $2,000 cash
    3. 2 Second Place Prizes - $500 cash
    4. The total ARV of all available prizes in this Contest is $7,600.00 (Seven Thousand Six Hundred Dollars). Any difference between the stated ARV and actual value of prizes awarded will not be awarded in any form.
    5. Winners are responsible for any and all local, state and/or federal, province taxes, as well as any other costs and expenses incurred in connection with participation in this Contest or accepting any prize. Prize will be awarded only if the potential prize winner fully complies with these Official Rules. Prize is non-assignable and non-transferable. Sponsor reserves the right in its sole discretion to substitute prize(s) of comparable value if any prize listed is unavailable, in whole or in part, for any reason.
    6. THE POTENTIAL WINNERS (AND THEIR RESPECTIVE PARENTS OR LEGAL GUARDIANS) ARE REQUIRED TO EXECUTE THE FOLLOWING: (1) AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE; (2) WARRANTY OF ORIGINAL WORK; (3) PUBLICITY RELEASE; AND (4) ANY OTHER AFFIDAVITS, DECLARATIONS AND/OR RELEASES OR ADDITIONAL DOCUMENTS THAT MAY BE REQUIRED. UNLESS PROHIBITED BY LAW, THE POTENTIAL WINNER (AND PARENT/LEGAL GUARDIAN) MUST SIGN THESE DOCUMENTS NO LATER THAN 5 DAYS FROM THE DATE OF RECEIPT OF PRIZE NOTIFICATION IN ORDER FOR SPONSOR TO AWARD THE PRIZE. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE MAY RESULT IN DISQUALIFICATION AND, AT SPONSOR’S DISCRETION, SELECTION OF AN ALTERNATE WINNER.
    7. No prize transfer, assignment or substitution by winners permitted. In the event of unavailability, Sponsor reserves the right to substitute prizes in which case a prize of equal or greater monetary value, determined in Sponsor’s reasonable discretion, will be awarded.
    8. Odds of winning will depend on the number of eligible entries received and the skill of the entrant in satisfying the Criteria.
    9. Should a winner be determined to have violated these Official Rules in any way or make any false statement(s) in any documents referenced herein, the winner will be required to promptly return to Sponsor his/her prize, or the cash value thereof.
    10. An entrant will not be officially declared a winner until the entrant’s parent/legal guardian has signed all required documentation.
  11. WINNER SELECTION DATES AND NOTIFICATION: Prize winners will be notified by email using the contact information provided at the time of entry. Sponsor shall have no liability for any notification that is lost, intercepted or not received by any potential winner for any reason. If, despite reasonable efforts, any potential prize winner does not respond within five (5) days of the notification attempt, or if the prize notification is returned as unclaimed or undeliverable such prize winner will forfeit his or her prize and an alternate winner may be selected.
  12. EXPENSES: Expenses incurred by entrants, their parent/legal guardian or any other entity in connection with entrant’s participation in this Contest, including but not limited to transportation, travel, accommodations, materials, data usage, Internet connectivity, incidentals, food, beverages, or time spent, shall be the sole responsibility of entrant, their parent/legal guardian or any other individual or entity who incurred such expense.
  13. PUBLICITY RELEASE: Entry in the Contest constitutes parent or legal guardian’s permission for the Sponsor to use entrant’s name, photograph, image, likeness, voice, biographical information, statements (collectively, the "Publicity Information"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization, (except where prohibited by law), and releases the Sponsors and Judging Panel from all claims arising out of the use of such Publicity Information.
  14. LIMITATION OF LIABILITY: Sponsor and Judging Panel are not responsible for, and entrant hereby releases Sponsor and the Judging Panel, their respective partners, affiliates, subsidiaries, agents, employees, officers, directors and representatives from any claims, losses and damages arising from: (i) entrant’s participation in the Contest or any Contest related activities; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the Contest, including but not limited to the entry process; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries; (vi) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest and (vii) use, misuse or possession of any prize.
  15. GENERAL:
    1. Entrants and their parent/legal guardian agree (a) to be bound by these Official Rules; and (b) that the decisions of the judges are final on all matters relating to the Contest.
    2. This Contest is subject to federal, state, provincial, territorial and local laws and regulations. Certain restrictions may apply. Sponsor is not responsible for late, lost, stolen, damaged, mutilated, incomplete, illegible, misdirected, or postage-due mail. Entries void if the Sponsor determines the entry to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft. Sponsor is not responsible for any typographical or other error administration of the Contest or in the announcement of a prize. Sponsor reserves the right to modify the Contest at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest for any reason, including, but not limited to, if computer viruses, computer bugs or other causes beyond Sponsor’s control corrupt the administration, security or proper play of the Contest. Sponsor is not responsible for computer equipment failures or for transmission problems in the event an online entry is not received, points are not scored or there is damage to an entrant’s equipment due to participation in the contest.
    3. All taxes, fees and surcharges on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize are/is ineligible or refuses the prize, the prize will be forfeited and Sponsor and Judging Panel, in their sole discretion, may choose whether to award the prize to another qualified entrant.
    4. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court in Allegheny County, Pennsylvania; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased.
    5. Tampering with the entry process or the operation of the Contest is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in violation of these Official Rules will be void. Sponsor’s computer will be the official timekeeper for all matters related to this Contest. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the person who is assigned to an email address by an Internet Access Provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.
    6. Sponsor is not responsible for lost, late, mutilated, misdirected, illegible, incomplete, inaccurate, or stolen, submissions or prize notifications. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No illegible, incomplete, forged or other automated multiple entries will be accepted.
    7. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event an insufficient number of eligible entries that satisfy the Criteria are received and/or Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Contest. Only the type and quantity of prizes described in these Official Rules will be awarded. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor.
    8. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
    9. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.
